What is the H1B visa and who is eligible to apply?

The H1B visa is a non-immigrant visa that allows U.S. employers to hire foreign professionals for specialty occupations. To be eligible, you must have a job offer from a U.S. employer, hold a bachelor’s degree or higher (or equivalent experience), and the job must require specialized knowledge.

Can H1B visa holders bring their family to the USA?

Yes. Spouses and unmarried children under 21 of H1B visa holders are eligible to apply for an H4 visa. This allows them to live in the U.S. for the same duration as the H1B holder.

Can H4 visa holders work in the United States?

H4 visa holders cannot work by default. However, they may apply for Employment Authorization (EAD) if the primary H1B visa holder has started the green card (permanent residency) process under specific conditions.

How long can I stay in the U.S. on an H1B visa?

An H1B visa is initially granted for up to 3 years and can be extended for a maximum of 6 years. Additional extensions may be possible if a green card process is in progress.
